In this photograph (presuming it is authentic), the truck in question is neither loading nor unloading. There is no evidence to prove that is making more than a momentary stop for an unknown reason - possibly something in the roadway.
Anonymous, I saw this same truck parked at that location yesterday, as I have seen trucks parked there many times before.
Very weird that you would question the report's "authenticity", are you suggesting that the truck was photoshopped into the bike lane or something? That would be a first for SeeClickFix, in my experience.
"There is no evidence to prove that is making more than a momentary stop for an unknown reason - possibly something in the roadway."
Drivers may only enter a bike lane when preparing for a right turn or to access a curbside parking space (California Vehicle Code 21209). Any other use of a bike lane by a car, truck, or motorcycle is prohibited, even momentarily.
"21209. (a) No person shall drive a motor vehicle in a bicycle lane established on a roadway pursuant to Section 21207 except as follows:
(1) To park where parking is permitted.
(2) To enter or leave the roadway.
(3) To prepare for a turn within a distance of 200 feet from the intersection. "
Irrelevant German Philosopher, I am just quoting the law. If you have a problem with the law then take that up with the state legislature. Until then, cars in bike lanes should be ticketed, unless they are preparing for a right turn or entering a parking spot.
Here's another photo of the truck parked in the bike lane at the same spot again this morning, approximately 11am.
So, you'd prefer that he let the bicycles run over the board with nails? None of these photographs offers any evidence that the vehicle - which could be multiple exposures of the same vehicle at the same time - is doing anything illegal.
You can speculate all you want Irrelevant German Philosopher, or you could just hang out on Shattuck Ave and see for yourself where these trucks are using the bike lane illegally as a loading zone nearly every single day. If I posted a video instead of a photo showing that the vehicle is indeed physically parked in the bike lane, not swerving out of the way of your phantom "board with nails", would that satisfy you? Or would you continue coming up with weird justifications for this illegal behavior?
Until these drivers cease this activity, then it should remain active so that Oakland Parking Enforcement can follow up on it.
